En abril de 2021, la Comisión Bicameral de Fiscalización de los Organismos de Inteligencia del Congreso Nacional en Argentina -creada hace veinte años con la finalidad de fiscalizar a los organismos pertenecientes al Sistema de Inteligencia Nacional- presentó un informe que suscitó un escándalo mediático en materia de actividades ilegales de espionaje.

Este trabajo analiza documentos del D2 de la policía de Santiago del Estero y de la oficina de inteligencia de una Base Aeronaval en Chubut con el objetivo de identificar sus clasificaciones para la identificación de actores y preguntarse, a partir de allí, respecto del rol de los organismos de información e inteligencia durante los períodos democráticos. Este aspecto, que sigue siendo una de las deudas de la democracia argentina, fue materia de legislación en 2001 con la sanción de la (...) Ley de Inteligencia Nacional 25.520. Sin embargo, el hallazgo de archivos militares y policiales que ocupan a este artículo dan cuenta de la continuidad de la práctica de investigación de antecedentes, reunión de información y producción de inteligencia por razones políticas sobre ciudadanos e instituciones. Esto abre interrogantes en torno a la idea de que el sentido de los documentos responde exclusivamente a las funciones formales del organismo productor. Antes bien, deben ser considerados como artefactos sociales que encarnan y reproducen repertorios culturales políticos de largo aliento, que forman parte de la llamada “baja política” pero que inciden en los procesos, conflictos y decisiones que se despliegan en la dimensión institucional de la política. Socially responsible business and ethical behaviour of companies have been of interest to academia and practice for decades. But the focus has almost exclusively been on large corporations while small- and medium-sized enterprises (SME) have not received as much attention. Thus, this paper focuses on socially responsible business practices of SME entrepreneurs or owner–managers in Germany. Based on the assumption that decision-makers in SMEs are the central point where all business activities start, members of a German entrepreneurs association were approached (...) in the course of a qualitative and quantitative survey. They were asked to assess in what way their social responsibility is expressed in specific management practices towards selected stakeholder groups. These practices in turn were assumed to result in perceived positive reactions of the respective stakeholders and subsequently to positively influence the firm's financial performance, i.e. cost reductions and increase in profits. In the paper, a research model is presented that elaborates the relationship between an SME executive's social responsibility and the value creation of a firm, i.e. whether (personal) values create (economic) value. It was found that socially responsible management practices towards employees, customers and to a lesser extent society have a positive impact on the firm and its performance. Telepsychiatry has long been discussed as a supplement to or substitute for face-to-face therapeutic consultations. The current pandemic crisis has fueled the development in an unprecedented way. More and more psychiatric consultations are now carried out online as video-based consultations. Treatment results appear to be comparable with those of face-to-face care in terms of clinical outcome, acceptance, adherence and patient satisfaction. However, evidence on videoconferencing in a variety of different fields indicates that there are extensive changes in the communication behaviour (...) in online conversations. We hypothesise that this might impact ethically relevant aspects of the therapeutic relationship, which plays a prominent role in psychiatry. In this paper, we review effects of video-based consultations on communication between therapists and patients in psychiatry. Based on a common understanding of video-based consultations as changing the lived experience of communication, we categorise these effects according to sensory, spatial and technical aspects. Departing from a power-based model of therapeutic relationships, we then discuss the ethical significance of this changed communication situation, based on dimensions of respect for autonomy, lucidity, fidelity, justice and humanity. We conclude that there is evidence for ethically relevant changes of the therapeutic relationship in video-based telepsychiatric consultations. These changes need to be more carefully considered in psychiatric practice and future studies. (shrink)

Nach Erläuterung der wesentlichen Begriffe wie „Emotion“ und „Gefühl“ stellt Eva-Maria Engelen die wichtigsten theoretischen Ansätze vor. Dabei spielen sowohl Theorien aus der Philosophie, der Psychologie als auch aus den Neurowissenschaften eine wichtige Rolle. Geklärt wird in weiteren Kapiteln das Verhältnis von Gefühlen und Emotionen zum Verstand, zum Bewusstsein und zu Werten.

Artificial intelligence is currently changing many areas of society. Especially in health, where critical decisions are made, questions of control must be renegotiated: who is in control when an automated system makes clinically relevant decisions? Increasingly, the concept of meaningful human control (MHC) is being invoked for this purpose. However, it is unclear exactly how this concept is to be understood in health. Through a systematic review, we present the current state of the concept of MHC in health. The results (...) show that there is not yet a robust MHC concept for health. We propose a broader understanding of MHC along three strands of action: enabling, exercising and evaluating control. Taking into account these strands of action and the established rules and processes in the different health sectors, the MHC concept needs to be further developed to avoid falling into two gaps, which we have described as theoretical and labelling gaps. Is musical practice 'real' - and how is it connected with everyday life? Eva-Maria Houben shows that making music changes as soon as its meaning is not sought in a purpose-oriented production of results, but in performing music as an activity - indeed, as play. Musical practice, Eva-Maria Houben contends, should be understood as open and never finished. Such an emphasis on repetition can free us from perfection, productivity, and purpose, allowing meaning to unfold in specific situations, places, (...) and relationships. Analyzing the ancient Greek point of view concerning anger, shame and justice and a very modern one, one can see, that anger has a regulative function, but shame does as well. Anger puts the other in his place, thereby regulating hierarchies. Shame regulates the social relations of recognition. And both emotions also have an evaluative function, because anger evaluates a situation with regard to a humiliation; shame, with regard to a misdemeanor. In addition, attention has to be paid to the (...) correct molding of these emotions and the correct ways of using them in rearing to be good or just (i.e., in personality formation. (shrink)

This paper works out which conceptual and theoretical preconditions have to be met, among others, in order for a living creature to be able to have a feeling of being alive beyond the mere capacity for sensation. For the emergence of such a feeling, which can be equated with a rudimentary phenomenal consciousness (1.), it is not enough for the organism to be alive (2. a.). Rather it has to be able to conceive its body as a unit and to (...) relate its sensations to this unit (2. b.). Moreover mobility (2. c.), a basic sense of possibility (2. d.) and a rudimentary sense of time (2. e.) are also necessary. The analysis of these preconditions relies primarily on Aristotelian theoretical approaches, encompassing both historical interpretation (3. a.), and systematic work, which includes a look at the current debates in the analytic philosophical tradition (3. b.). Owing to technological advances, genomic medicine is moving from specific to broader genetic analyses and from specialised to mainstream services. Sahan et al 1 point to complex ethical cases encountered by clinical laboratory scientists in the context of genomic medicine’s expansion. The authors discuss debates on interpreting and reporting genetic results, offering extended genetic testing and differences in the perceived responsibility of clinical laboratory scientists in different settings. As demonstrated by the case examples in the article, while genomic medicine holds (...) the promise of providing clinical answers, its mainstreaming can introduce a new type of ‘odyssey’ for patients and/or relatives, such as when there are uncertain findings. The integration of genomics in healthcare at large can also impact communication decisions and perceptions of responsibility for clinical laboratory scientists. Clinical laboratory scientists might report less to non-specialists than to genetic/genomic specialists, as they feel responsible for minimising the potential of non-specialists misunderstanding, misinterpreting or miscommunicating the genetic findings to patients.1 In this way, the perceived responsibility affects patients and the type and amount of genetic information they receive. Empathy as “Feelingly Grasping” Perhaps the central question concerning empathy is if and if so how it combines aspects of thinking and feeling. Indeed, the intellectual tradition of the past centuries has been marked by a dualism. Roughly speaking, there have been two pathways when it comes to understanding each other: 1) thinking or mind reading and 2) feeling or empathy. Nonetheless, one of the ongoing debates in psychology and philosophy concerns the question whether these two abilities, namely, understanding what (...) the other is thinking and “understanding” what the other is feeling, are separate or not. Most of the authors in this volume consider the cognitive and affective dimensions at work within empathy. Each author does this within and beyond their own field. Coming from the humanities, we propose the following definition for empathy: Empathy is a social feeling that consists in feelingly grasping or retracing the present, future, or past emotional state of the other; thus empathy is also called a vicarious emotion. We would like to highlight two aspects of this definition in particular: 1.) the peculiar position of “grasping” which involves a cognitive dimension and 2.) the social dimensions of relating to the emotions of another human being. Die Arbeit verfolgt Entwicklungslinien eines auf praktische Vernunft gestützten Republikmodells an Hand der exemplarischen Bedeutung der aristotelischen Politik und ihrer Rezeption durch Thomas von Aquin. Diesen werden auch entscheidende Weichenstellungen für die Ausbildung des modernen Staatsbegriffs und seines begrifflichen Instrumentariums politischer Vernünftigkeit zugerechnet. Teil 1 stellt das aristotelische Modell der auf den Begriff des Menschen als Menschen gegründeten "bürgerlichen Gesellschaft" vor, in der sich ein gegenüber der Beliebigkeit tatsächlicher Herrschaftsan-massungen kritischer ursprünglicher Zusammenhang zwischen dem Verständnis "politischer Herr-schaft" und der wechselseitigen (...) "Anerkennung" konkret freier und gleicher Bürger präsent hält. Dieser ruht jedoch auf einschränkenden Voraussetzungen politischer Subjektivität und deren unmittelbarer Bindung an institutionelle Rahmenbedingungen auf, wie sie aus einem spezifisch antiken Verständnishorizont, näherhin aus dem aristotelischen Konzept entelechialer Teleologie, erläutert werden. Der Versuch einer Einordnung in Grundlinien des umfassenden systematischen Kontexts in Metaphysik, Physik und praktischer Philosophie soll gerade durch den gegenüber der unbestrittenen aktuellen Relevanz neuzeitlichen Freiheitsethos differenzierenden und nicht ungeschichtlich-planen Zugang zu diesem Politikmodell auch aktualisierende Perspektiven eröffnen. So soll etwa durch die Erläuterung der aristotelischen Teleologiekonzeption, die anhand des Paradigmas der Naturbewegung eingeführt wird, sowie des dazu korrespondierenden Ethos "vernünftigen Strebens" das etwaige Verständnis einer vorgängigen materialen Zweckbindung der Politik, im Sinne etwa einer herkömmlichen "Werteethik", distanziert werden. Das Verhältnis Naturteleologie - Praxis wird nicht deduktiv, sondern als ein solches der Strukturanalogie bei gleichzeitiger methodischer Abgrenzung verstanden. Teil 2 widmet sich der Herausarbeitung systematischer Akzentverschiebungen und Umformungen im Spannungsfeld der Konfrontation von aristotelischer Teleologie bzw. praktischer Vernunft mit einer von der Perspektive der Geschichtlichkeit geprägten Offenbarungsreligion bei Thomas von Aquin. Im Zeichen eines vorläufig theologisch gewonnenen universalen Freiheitsverständnisses vollzieht sich auch ein Strukturwandel politischer Öffentlichkeit, der zunächst eine institutionelle Verdünnung des republikanischen Ideals herbeiführt. Durch die Rücknahme des Ziels der Politik vom konkreten Bürger-ethos in die Universalität und den nunmehr transzendentalen Anspruch des Begriffs des "bonum commune" wird gleichzeitig aber auch ein Prozess der Pluralisierung und Dynamisierung gesellschaft-licher und individueller Zielsetzungen und Praxisformen freigesetzt. Entscheidende Bedeutung kommt dabei dem Stellenwert des thomasischen "Gesetzes" zu, in dem - jenseits einer material-deduktiven oder imperialistischen Konzeption - ein dezidiert praktisch-handlungsleitendes Gesetzesverständnis zum Vorschein kommt. Dieses führt die sittlich-politische Anerkennung stiftende Funktion der "koinonia politike" weiter und leitet in seinem Anspruch gesteigerter "Allgemeinheit"--Dies sowohl im Rückgang auf ein transzendentales Prinzip seiner Begründung wie auch in der Ausweitung seines Adressaten-kreises - zur Neuzeit über. The French nineteenth century artists Henry Toulouse-Lautrec (1864-1901) is known for his distinctive style and bold character portraits of the theatrical scene of the gaslight era in Paris. The paper examines some of the formative influences of eighteenth century Japanese art on the development of visual characters, with specific focus on a lithograph entitled Divan Japonais. Alluding to the refined representation of Japanese courtesans, subtle nuanced reminiscences to an ideal of elegance create an allusion to highly respected courtesans in the (...) Japanese ‘Green Houses’ of the Asian Yoshiwara the famous “Good Luck Meadow” in Edo, present day Tokyo. I argue that Lautrec draws on techniques in Asian art, effectively creating a visual language that suggests a carefully crafted reevaluation of values. Lautrec’s visual language promotes sensibilities characteristic for a Japanese aesthetic and lifestyle that are also intrinsic to a traditional cultivation of moral virtues in Asia. The argument will be developed in conjunction with an analysis of diverse forms of visual language apparent in two works of Lautrec, a print by the Japanese artist Kitagawa Utamoro (1753-1806), and a photo of the dancer Jane Avril (1868—1943). The relation between seeing, knowledge, and language has concerned philosophers and artists throughout history. The current article examines the relation between word, image, and knowledge in some prominent Renaissance artworks. It is argued that the shift from revelatory truth in the word to evidence in “seeing the real” as Leonardo da Vinci (1452 -1519) argues in his writings, marks a moment in history in which the human being takes center stage as the interpreter of knowledge. In the search for perfect (...) proportionality and beautiful harmony, Renaissance artists, therefore, did not just create an aesthetic dimension yet were central in a process leading to a reevaluation and alternative modes of knowledge about the human being. Die Ausführungen zum Begriff der Liebe in Hegels Ästhetik lassen sich als Spuren der Auseinandersetzung Hegels mit der Vereinigungsphilosophie lesen. Nach der These dieses Aufsatzes enthält die Ästhetik diese Spuren also noch, obgleich Hegels Abschied von der Vereinigungsphilosophie längst vollzogen war, als die Vorlesungen zur Ästhetik entstanden sind. Die Begriffe Philosophie der Vereinigung und Vereinigungsphilosophie bezeichnen Positionen in der Philosophie des 18. Jahrhunderts, die sich mit der Selbstwerdung des Subjekts oder des Bewußtseins befassen und mit der für die Selbstwerdung erforderlichen (...) Hingabe an ein Äußeres, Anderes. Infolge der Hingabe an ein Äußeres, Anderes werden dem Selbst die Grenzen und der Grund seines Selbst bewußt. Das Selbst benötigt demnach das Andere, um zu sich selbst zu kommen. Die Hingabe an das Endliche außer uns, die erforderlich ist, um in Abgrenzung zum Anderen zu einem Selbst zu werden, wird als Liebe im Sinne des Eros bestimmt. Diese Liebe ist der Antrieb, die Vereinigung mit dem Erstrebten zu suchen und die Erkenntnis des Wahren zu fin Für die Selbstwerdung oder Selbsterkenntnis werden dabei, je nach philosophischer Konzeption, unterschiedliche Bereiche als Ort der Vereinigung angenommen: Der Bereich der Religion, der auf die Erkenntnis Gottes und der Seele abhebt, die nur in der Wiedervereinigung der Seele mit Gott im Jenseits zu erlangen ist. Oder der Bereich des Schönen, der für Hölderlins Philosophie der Vereinigung zentral ist. Die allen Formen der Vereinigungsphilosophie zugrundeliegende Frage ist die nach dem Verhältnis zwischen dem Selbst (oder der Seele) und dem Begehrten, das zur Selbstwerdung gebraucht wird. Infants who suffer severe neglect fail to thrive emotionally as well as bodily. The absence of early coexistential structures that provide well-being leads to a narrowing of the child's perceptual and social developmental horizon. What is the nature of these early structures? In this essay, an ontology of well-being or housedness is elaborated through phenomenological reflections on breast-feeding and infant perception. Merleau-Ponty's ontology of the flesh makes a contribution to the ontology of well-being: it gives us a conceptual and evocative (...) language to describe human existence in its pre-verbal, syncretic, and non-dualistic manifestations. It also allows for a re-evaluation and re-interpretation of the results of current research in infant perception. Through the structures of infant perception we perceive the coexistential fit between infants, other human beings, and the world of things. An infant's fundamental housedness in the flesh is taken up and cultivated or destroyed by the child's social and cultural environment. (shrink)

This article examines the relation between the biblical Word and visuality in one of the surviving early thirteenth century manuscripts of the Bible moraliseé, the codex Vindobonensis 2554 today housed in Vienna. The analysis focuses specifically on the relations between word and visuality. The goal is to investigate the vitality that may set the Word into motion. It is argued that the matrix of textual visuality in the Vienna codex 2554 is used as an effective tool that adds vitality to (...) the biblical passages while simultaneously creating a firm hierarchy of representation and resemblances that enforces not only certain norms but also a particular world order in 13th century French society. Breast milk and the placenta are phenomena of female human embodiment that challenge the philosophical notion of separate, sovereign subjects independent of other human be­ings and an objective world “out there.” A feminist phenomenological analysis, indebted to Merleau-Ponty and Irigaray, reveals placenta and milk to be intercorporeal, “chiasmic” forms of shared organic existence. This analysis is a philosophical and psychological exploration of “matrotopy,” i.e., the fact that humans eat their mothers through breast milk and placenta. This exploration, however, requires an (...) understanding of the larger environmental field which sustains the female body and its offspring. Environmental degradation, particularly through estrogen mimicking substances in plastics and pesticides, targets the endocrine system of developing fetuses and endangers the future of the human species from the inside. Invisible organo-chemical technologies pose a new and immediate danger and ethical challenge to women and men in the twenty-first century. A “placental ethics” respects the insertion of the human being into the dynamic field of nature; it calls for an awareness that, unless we develop a changed attitude toward technology, the gradual extinction of our species continues to happen in female bodies today. In this thesis, I attempt to reconcile two alternative approaches to justice: distributive and relational egalitarianism. When examining the two accounts, I claim that relational egalitarianism has distributive egalitarian implications. This implies an extensional overlap between the two accounts, namely a correspondence between the normative outcomes of relational and distributive egalitarianism. This work is addressed primarily to relational egalitarian scholars, as well as others who are convinced by the value of relational equality as a worthy moral and political ideal. My (...) aim is to prove that their goal implies embracing equality of distribution beyond relational equality. When making the case that relational egalitarians should take equality seriously, I claim that they should refrain from embracing distributive principles other than – or incompatible with – principles of distributive equality. This statement entails both a negative and a positive thesis. On the negative side, we should be critical toward the prominent tendency within the relational egalitarian debate, as influenced by the work of Elizabeth Anderson, to reject claims of distributive egalitarian justice in favour of sufficientarian claims of distribution. On the positive side, distributive equality is required by the logic of relational egalitarianism, although its normative significance exists independently of it. While presenting my statements, I provide support for the externalist understanding of relational equality as most recently advanced by Kasper Lippert-Rasmussen, through which the egalitarian character of someone’s relation depends on features external to their relation, such as on the distribution of the relevant currency among them. Whether or not individuals relate to one another as equals – I maintain – depends not merely on the internal feature of their relation, that is, on how they perceive or regard one another, but also, significantly, on how goods such as resources, welfare or opportunities are distributed among them. On my account, individuals are only equals when they recognize each other as equal in status and grant one another an equal share of the justice-relevant good. In defending my thesis, I critically engage with the literature on both distributive egalitarianism and relational egalitarianism. In particular, in the first part, I reconstruct the egalitarian debate and its approach to equality as either a relational or a distributive ideal. In the second part, I question such either/or relation by arguing that relational equality implies distributive equality, because arbitrary distributive inequality violates the deliberative constraint of relating as equals. I strengthen this claim by looking at the particular instantiation of distributive inequality in the field of education, and unveil its theoretical implications while supporting the project of reconciling distributive egalitarian and relational egalitarian approaches to justice. In my view, relational and distributive egalitarianism are compatible theories within one and the same egalitarian framework. Their normative outcomes are – at least in part – equivalent. (shrink)

Goethe belongs to the phenomenological tradition for a number of reasons: He shared Husserl's deep mistrust of the mathematization of the natural world and the ensuing loss of the qualitative dimension of human existence; he understood that the phenomenological observer must free him/herself from sedimented cultural prejudices, a process which Husserl called the epoche; he experienced and articulated the new and surprising fullness of the world as it reveals itself to the patient and participatory phenomenological observer. Goethe's phenomenological sensibilities and (...) insights become more apparent when his work is brought into dialogue with Husserl's thinking. In turn Goethe challenges Husserlian phenomenology to a more careful investigation of the natural world and human participation within its order. Both Goethe and Husserl are searching for a science of the qualitative dimension of being. (shrink)
